[hardy] error communicating with backend using LiveCD

Bug Description

Binary package hint: update-notifier

When booting the daily build from 20080109 update-notifier appeared as a stop / warning sign and said "Error communicating with backend. Please report this bug." In '/var/log/apt/term.log' I found the following:

Log started: 2008-01-09 08:05:27
Can not write log, openpty() failed (/dev/pts not mounted?)
Can not write log, openpty() failed (/dev/pts not mounted?)
Log ended: 2008-01-09 08:08:39

TEST CASE:

PROCEDURE:
1) Boot Live CD
2) Wait for desktop to load
3) Mouse over update-notifier icon in tray

RESULT ON PASS:
1) Icon has no error message

RESULT ON FAIL:
1) Notice message "Error communicating with backend"

update-notifier is version 0.70.1 on the Live CD.

  * src/update.c:
    - string fix (thanks to Brian Murray, LP: #181375)
    - do not display a error when running on the live-cd
      and apt-check is symlinked to /bin/true

I can confirm with "Xubuntu Hardy Alpha 3".

Although the behavior disappears after installing from liveCD.
