windows with no title bar when effects are enabled

LatestVersionTested: compizconfig-settings-manager 0.7.4-0ubuntu2

using nvidia-glx-new on GeForce FX5500 resolution 1280x768
error occurs when I try to enable effects using system>preferences>appearance
ps: I have had this problem with fiesty and maybe edgy with beryl but thats sorted.
