OK, *another* follow-up. Installed wicd instead of network-manager. That works!
Reverted kernel back to 3.2.0-25 (i.e. stock), nohwcrypt is 0 (off).
The background scanning and the ath9k module are at the root of this problem, installing wicd is a work around.
