One more data point...I just did a fresh install of hardy alpha 2 on my Dell D600/BCM4306 and the bug is still present in the 0.6.5-0ubuntu11 version.

The good news is that the same patch that worked for 0.6.5-0ubuntu10 also works for this version, too.

Also, in case it saves anyone some grief, the b43legacy driver was accidentally excluded from the hardy kernel in alpha 2 (https://bugs.launchpad.net/bugs/178409), so you'll need to build it manually. The fix is committed, though. :-)
