privacy banner is not shown by default when reporting a bug

Bug Description
When reporting a bug on a project that has default private bugs the red privacy banner is not shown, but the information type of the bug is private. The banner does show if I change the information type. I suspect the initial state problem is caused by the switch from a checkbox or .private_bugs property to radio buttons.
