VM goes to "Build timeout" state if the instance is rebuilded with an image in state "queue"

Bug Description
1. Create a VM from HP provided standard image
2. Take a snapshot while the VM is in BUILD state
3. Rebuild the VM while the VM is in BUILD state and IMAGE is in QUEUE state
Observation:
VM goes to BUILD timeout (shows in euca)/ ERROR(shows in NOVA) state
Image stays in queue state for ever
Expected Result:
1. it should not allow me to rebuild the VM if its in any state rather than ACTIVE
2. It should make the snapshot active when the VM goes to active state.

I 've tried to reproduce the bug in ESSEX version.
created a VM
I took a snapshot while the VM is in BUILD state
which results in a message saying "Cannot 'createImage' while instance is in vm_state building (HTTP 409)"
Seems that bug got fixed in ESSEX version
