Joseph, Bug number 1007089 covers the bug/feature with regards to the kernel. This bug is about start-stop-daemon not functioning as it should with regards to specific 'mannerisms' of released kernels. This bug should only be considered fixed if and when start-stop-daemon behaves correctly with kernels that exhibit this behavior and with kernels that don't.
Cheers!
P.S. Please see bug number 1007089 where the vary same question was "asked and answered", by none other then YOU and ME!
