partman throws error msg for sda5 during installation

Bug Description

Binary package hint: ubiquity

Kubuntu 9.04RC 4.20.9 Desktop Install
side by side install choice

Partman throws the error message in the attached .png file
This error is given 3 times during the partitioning stages
but choosing Ignore will allow the installation to complete.

Not sure why sda5 is even mentioned, the partitioner chooses
sda10 to resize and creates sda11 and sda12

sda5 has Ubuntu 8.10 that was upgraded to 9.04 using upgrade-manager
on 4/20/9.

sda6 has Ubuntu 8.10
