error when rebuilding a instance booted from volume

Bug Description

with libvirt driver as compute virt driver, when rebuild a instance booted from a bootable volume, instance will be set to "ERROR" state, the error log in log:
libvirtError: Failed to terminate process 8804 with SIGKILL: Device or resource busy

The same error happened to me. As a workaround for this issue i first shutdown the instance before rebuilding and it appeared to be working as the instance is displayed with the new image in Nova. However the volume I am booting from remains unchanged (with the old image).

I am using Juno.

There is another error about rebuild happened to me. I create a instance by a volume, but when I'm try to call API(rebuild method) to rebuild it use another image. In the end the instance information has changed ,but when the os of instance has not change at all.

Reason: I abandon this, since a proper solution would require rethinking of rebuild. It is not defined yet how rebuild should work with volume-backed instances. Someone should write a bp about this.

I'm confused about what's being reported as the bug here. Comments 1 and 2 are for different issues, which are reported in bug 1482040. There are too few details in the description of this bug report about why it failed, was it due to the same issue in bug 1522496?

Regardless, I'm going to mark this as incomplete until there is more information or it expires because it's either fixed, a duplicate, or something else but that's not clear from the description.
